PROVINCIAL OFFENCES APPEALS

Were you running your own trial?
Was the information not clear?
Were you not happy with the outcome?
Were you convicted without any notice?

File an Appeal

An appeal is a request to a higher court to review a lower court trial or other decision.

Provincial Offences Act Appeals

  1. Appeal Judge’s Authority
      • Uphold trial decision
      • Reverse trial decision
      • Modify trial decision
      • Order a new trial
      • Must show deference to the trial decision
      • No power over demerit points and negative insurance consequences
  2. Appeals Against Conviction (Judge may allow if satisfied that):
      • Conviction was unreasonable or not supported by evidence
      • Trial court erred in law
      • Miscarriage of justice occurred
  3. Appeals Against Sentence (Judge may allow if):
      • Error in principle by the trial court
      • Failure to consider a relevant factor
      • Overemphasis on a factor
      • Sentence is clearly wrong
  4. Timing of Appeal Decision
      • Judge may decide on the day of the hearing
      • May require more time, leading to:
        • Another hearing date for an oral decision
        • Written decision sent to parties
      • Ordering a New Trial
          • Case sent back to the original court
          • Notice sent to the appellant about the court date

Reopening

  • If you are convicted in respect of a ticket without a hearing, you can apply to have your conviction struck out and a new trial scheduled.
  • You must apply for this “reopening” within fifteen days of becoming aware of the conviction.

Appeal Process

  • A Notice of Appeal is to be filed within 30 days (from the date of conviction)
  • Any Outstanding Fines should be paid and the proof of such payment is to be submitted with the Appeal.
  • Trial Transcripts have to be ordered and submitted with the Appeal.

Beyond grateful to this business. I was fortunate to work with Hetish who kept me calm and informed at every single step. He went out of his way to make certain my case was heard to the full extent and worked diligently (for months) to find favourable ways to prove it. Every single one of my charges were dismissed.
Do not hesitate to book and highly recommend asking for Hetish. Thank you sir for all that you did!

I would like to thank Ed and his team for their assistance with my ticket issue. The outcome was the best and most positive outcome I could imagine, and I am so grateful and appreciative.
I would highly recommend them to anyone I know, and after a rough year in 2024, this was a wonderful way to start a new year. I feel very fortunate. Thank you so much for this gift and your hard work.

I called them and spoke with one representative and she was wonderful. They are very helpful, honest and are efficient with their communications. The representative that I had really did get me the best outcome possible given my situation.
I would definitely choose them over X-Copper. That amazing!! 10 stars out of 5! Thank you so much. Hopefully won't need your services in the future, but if I do there will be no hesitation.
