Careless Driving

Careless Driving includes 6 demerit points, for a fully-licenced G driver. For G1/G2/M1/M2 or hybrid drivers (combination of any graduated licence and full G or M), instead of the 6 demerit points, you will automatically receive a 30-day driver’s licence suspension, for a first offence.* *Ontario.ca

Careless Driving Offences

Here are some of the charges that can be associated with careless driving:

1. Careless Driving: This charge refers to driving without due care and attention or without reasonable consideration for others using the road.
2. Careless Driving Causing Bodily Harm or Death: If a driver’s careless actions result in bodily harm or death to another person, the penalties can be more severe, including higher fines, longer license suspensions, and potential imprisonment.

Careless Driving not causing bodily harm

In Ontario, the consequences and penalties for careless driving not causing bodily harm are governed by the Highway Traffic Act under Section 130. A conviction for this offence can result in the following penalties:

  1. Fines: Careless driving fines can range from $400 to $2,000, depending on the severity of the offence and whether it’s a first-time or repeat offence.
  2. Demerit Points: A conviction for careless driving adds six demerit points to the driver’s record. Accumulating a certain number of demerit points can lead to further penalties, such as license suspension.
  3. License Suspension: Depending on the circumstances and the driver’s history, a careless driving conviction can result in a license suspension of up to two years.
  4. Insurance Premiums: A careless driving conviction is likely to cause an increase in the driver’s insurance premiums, as they are now considered a higher risk by insurance companies.

Charged with Careless Driving

If you face charges of careless driving or careless driving causing bodily harm or death in Ontario, it is vital to follow these steps to protect your rights and minimize potential consequences:

1. Maintain composure and cooperation: When charged, stay calm and cooperate with law enforcement officers. Refrain from arguing or admitting fault, as your statements may be used against you in court.

2. Collect information: Gather as much information as possible regarding the incident, including witness names and contact details, photographs of the scene, and any pertinent documents or records.

3. Consult a POINTTS™ Traffic Ticket Specialist: Seek counsel from a Traffic Ticket Specialist experienced in handling careless driving and careless driving causing bodily harm or death cases. They can help clarify the charges, potential consequences, and available legal options.

4. Understand your rights and legal obligations: Familiarize yourself with your rights, including the right to remain silent, the right to legal representation, and the right to a fair trial. Also, be aware of your legal obligations, such as attending court hearings and complying with any court orders.

5. Prepare a strong defense: Collaborate closely with your Traffic Ticket Specialist to develop a robust defense strategy tailored to your case. This preparation might involve gathering additional evidence, interviewing witnesses, and scrutinizing the details of the incident to identify potential weaknesses in the prosecution’s case. By taking these steps, you can work towards the best possible outcome for your situation.

Careless Driving causing bodily harm or death

In Ontario, the consequences and penalties for causing bodily harm or death are more severe than those for a standard Careless Driving charge. These penalties are outlined in the Highway Traffic Act under section 130(3). If convicted, a driver can face the following consequences:
  1. Fines: Fines for Careless Driving causing bodily harm or death range from $2,000 to $50,000, which is significantly higher than the fines for a standard Careless Driving charge.
  2. Demerit Points: A conviction for Careless Driving causing bodily harm or death results in six demerit points added to the driver’s record. Accumulating a certain number of demerit points can lead to further penalties, such as license suspension.
  3. License Suspension: The driver’s license can be suspended for up to five years, depending on the circumstances and the driver’s prior record.
  4. Insurance Premiums: A conviction for this offence will likely lead to a significant increase in the driver’s insurance premiums, as they are now considered a higher risk by insurance companies.
  5. Criminal Record: Although Careless Driving causing bodily harm or death is not a criminal offence under the Criminal Code of Canada, a conviction will appear on the driver’s driving record, which can have long-lasting repercussions for employment and insurance.
  6. Imprisonment: A conviction for this offence can result in a jail term of up to two years, depending on the severity of the incident and the driver’s history.
