Careless Driving not causing bodily harm
In Ontario, the consequences and penalties for careless driving not causing bodily harm are governed by the Highway Traffic Act under Section 130. A conviction for this offence can result in the following penalties:
- Fines: Careless driving fines can range from $400 to $2,000, depending on the severity of the offence and whether it’s a first-time or repeat offence.
- Demerit Points: A conviction for careless driving adds six demerit points to the driver’s record. Accumulating a certain number of demerit points can lead to further penalties, such as license suspension.
- License Suspension: Depending on the circumstances and the driver’s history, a careless driving conviction can result in a license suspension of up to two years.
- Insurance Premiums: A careless driving conviction is likely to cause an increase in the driver’s insurance premiums, as they are now considered a higher risk by insurance companies.

- Demerit Points: A conviction for Careless Driving causing bodily harm or death results in six demerit points added to the driver’s record. Accumulating a certain number of demerit points can lead to further penalties, such as license suspension.
- License Suspension: The driver’s license can be suspended for up to five years, depending on the circumstances and the driver’s prior record.
- Insurance Premiums: A conviction for this offence will likely lead to a significant increase in the driver’s insurance premiums, as they are now considered a higher risk by insurance companies.
- Criminal Record: Although Careless Driving causing bodily harm or death is not a criminal offence under the Criminal Code of Canada, a conviction will appear on the driver’s driving record, which can have long-lasting repercussions for employment and insurance. Imprisonment: A conviction for this offence can result in a jail term of up to two years, depending on the severity of the incident and the driver’s history.
Fines, Penalties & Demerits
Careless Driving (Section 130 of the Highway Traffic Act):
- Fines: $400 to $2,000
- Demerit Points: 6 points
- License Suspension: Up to 2 years (depending on circumstances and driver’s history)
