Fail To Remain At An Accident

(1) Where an accident occurs on a highway, every person in charge of a vehicle or street car that is directly or indirectly involved in the accident shall,

(a) remain at or immediately return to the scene of the accident;

(b) render all possible assistance; and

(c) upon request, give in writing to anyone sustaining loss or injury or to any police officer or to any witness his or her name, address, driver’s licence number and jurisdiction of issuance, motor vehicle liability insurance policy insurer and policy number, name and address of the registered owner of the vehicle and the vehicle permit number.*

Understanding the Penalties for Fail to Remain

Fail to Remain incidents under the Highway Traffic Act carry severe penalties, including:

  • Jail time of up to 6 months
  • Fines ranging from $400 to $2,000
  • 7 demerit points on your driving record
  • 30-day suspension for G1 and G2 drivers
  • Possible license suspension for up to 2 years for all drivers
  • Potential 100% increase in insurance rates

Fail to Remain incidents can also lead to penalties under the Criminal Code of Canada, including:

  • Fines
  • A criminal record that lasts a lifetime
  • License suspension or prohibition for 1 to 3 years
  • Jail time of up to 5 years for serious offenses or incidents
  • Possible probation, restitution, or other conditions

To avoid these serious consequences, it is crucial to seek legal assistance promptly.

When a fail to remain accident occurs, police investigations may proceed in various ways:

  • An officer may attend the accident scene, conduct an investigation, and contact you directly.
  • An officer may attend the accident scene, complete a report, and forward it to a detective for further investigation.
  • The driver involved may go to a Collision Reporting Centre to file a report.

In instances of fail to remain accidents, police may initiate immediate follow-up actions, or it may take time for detectives to investigate the matter and reach out to you. Prompt action and cooperation with law enforcement are essential in these situations.
